A murder fugitive, who has been wanted since 1977 in connection with a fatal shooting at a downtown Denver bar, is back to Colorado after investigators tracked him down in Texas.

84-year-old Benito Soto, has been charged with one count of first-degree murder for the death of Armado Garcia, who was murdered at the Denampa Bar on Larmier Street on the night of June 21, 1977.

Soto allegedly left the bar, returned back and shot Garcia, according to the initial arrest affidavit from September, 1977. Witnesses said that they heard two gunshots and found the victim bleeding on the ground outside the bar.

Police identified Soto the night of the shooting, and issued a warrant for his arrest.

Soto fled Denver right after the shooting, and the case went cold for forty years because his whereabouts remained unknown.

A few months ago the fugitive unit of the Denver Police Department found Soto in Texas and the Denver District Attorney’s Cold Case Unit re-opened the case.

It is the oldest case that this unit has ever prosecuted.

Soto is being held without bond in the Denver city jail.

When asked if he remembers Armando.

"Who? They said I did it, I don't remember," Soto said.

Soto seemed confused about what happened that day in 1977.

"I'm going to die before I even go to court," Soto says, "Only a miracle from God can save me."

According to Ken Lane from the Denver District Attorney’s Office, the memories of Soto may have been faded over time, but the need for justice has not.

"You're finally being able to bring justice to a victim's family and that's the most important part of a cold case," Lane said.

Soto is expected to appear in court soon on a first degree murder charge.

A preliminary hearing in the case has been scheduled for 21st of next month.
